1. Parties & scope
These Terms govern access to https://datastreamnest.digital (the “Site”) operated from Hwaseong-si, Republic of Korea. By requesting information, downloading materials, or enrolling in paid cohorts, you agree to this archive plus the linked Cookie handling sheet and Refund pathway.
2. Data controller identity
Datastream Nest acts as controller for personal data collected through forms, billing, and classroom tooling. 3. Categories of personal data
We process contact fields (name, email, company), billing identifiers, attendance telemetry derived from learning platforms, technical diagnostics (browser type, coarse IP region), and content you voluntarily upload to labs (notebooks, logs) when exercises require submissions.
4. Purposes & legal bases
Contract performance: delivering courses, issuing certificates, processing payments. Legitimate interests: securing sessions, preventing abuse, improving lab UX metrics in aggregate. Consent: non-essential cookies and optional analytics pixels where applicable. Legal obligation: responding to lawful requests from regulators.
5. Retention
Inquiry records: up to 24 months unless a sale forms, then financial records follow statutory accounting windows. Classroom artifacts: retained per cohort agreement, default 12 months after completion unless you request earlier deletion that does not conflict with fraud monitoring holds.
6. Third-party recipients
Hosting providers, email delivery services, payment processors, and classroom platforms receive data strictly under documented instructions. We do not sell personal data. Any sub-processor change is logged in the compliance archive appendix we email to active customers quarterly.
7. International transfers
Primary processing occurs in the Republic of Korea. If tools temporarily route through other regions, we rely on standard contractual clauses or vendor certifications and document transfer impact assessments when required.
8. Security measures
TLS for transit, role-based access for staff, VPN-gated lab infrastructure, and quarterly access reviews. No security practice is absolute; we commit to notifying affected learners without undue delay when incidents meet legal thresholds.
9. Children’s privacy
Programs target adult professionals. If we learn we collected data from a person under 16 without verified parental authority, we delete such records unless a narrow legal exception applies.
10. User rights & complaints
You may request access, rectification, deletion, restriction, or portability where applicable under Korean personal information law and supplementary GDPR-style arrangements for EU visitors. Contact privacy@datastreamnest.digital. You may also lodge complaints with the Korea Personal Information Protection Commission.
11. Policy changes
Material updates receive dated revision stamps at the top of this page and, when practical, email notices to active cohorts. Continued use after posting constitutes acceptance except where law requires explicit consent.
12. Limitation of liability
Training materials are educational, not production warranties. To the fullest extent permitted, liability caps at fees paid for the specific cohort giving rise to the claim during the twelve months preceding the event.
